Collection action on a medical bill that I was making payments on

I had surgery at a major OK City hosipital in Jan/06. I have insurance with the Company that I work for, but the deductable was over $1,000. I called the hospital and asked them if I could send $40/month, and they said that I would have to talk to the collections agency, which I did. They have been cashing my $40 check each month. Then, today, I get served with papers demanding I pay he entire outstanding debt! The process server told me that I need to find the money somehow. I thought that as long as I made that payment each month, and they were accepting it, I was alright. Will a judge be sympathetic to my situation (single mom with no cs, and other medical bills to pay)?

If a judgment is entered, and your employer is served with a garnishment, file the garnishment paper that requests an exemption for "undue hardship" and file for a hearing with the county court. Likely, the judge will grant your application and you will pay $40.00 a month. However, a judgment bears, interest, possible attorney fees and costs so you will owe more than the balance of the medical bill. You might directly call the medical billing department and complain that that they did not follow the agreement.
