Legal Question in Credit and Debt Law in Oklahoma

Collection of a debt

My bankruptcy was dismissed in February 2006. I had listed everything that was on my credit report. I have been contacted by a collection agency saying I owed this debt. I have not heard from this company in a year and a half. I asked them to send me an invoice two years ago stating what I owed and they did not respond. I have not received anything from them until now. I thought my ex-husband was responsible because the insurance was in his name, but the collection agency sent me a copy of where I signed as the patient. Do I need to set up payments?

Re: Collection of a debt

If the debt is very small, I would probably go ahead and pay it. Otherwise, you could hire an attorney to contest the debt and argue that it did not matter that the debt was not listed on a chapter 7 bankruptcy since there were no assets for distribution, the debtor was not prejudiced by not being listed.
