Legal Question in Credit and Debt Law in Oklahoma
Collections for back pay on our mini storage unit
We rented a mini storage unit earlier this year and because of a financial emergency have not been able to pay on it. The manager of the facility has been harrasing us for a pay
ment. He called us at home on a Saturday night at 10:45pm wanting a payment of $85.00. On Monday we received a certified letter stating that our lock has been cut off and if we want our storage we must pay $325.00 by July 23 or everything will be sold. I received another phone call today (July 9th) from this same man informing me that the contents of our storage unit will be sold in the morning. Can he legally do this before the date on his certified letter to us? If not, how do we handle this manner and are we entitled to compensation for our personal belongings? What about the harrassment?

If he sells your belongings before he is statutorily authorized to do so, I expect that you will be entitled to compensation. I think he has to give you 30 days.
If the owner is using a debt collection company, it could be liable for unfair debt collection practices.
