Legal Question in Credit and Debt Law in Oklahoma

My deceased fathers unknown debt..

My mother had received a phone call today from a credit card company claiming that my dad, who passed away the 12th of June this year, owes them five thousand dollars. They've asked for my sisters named Cindy and even have knowledge of her address, we (my mother and I) believe that my sister owes them this money, and we suspect that she used my dads identity(his social security number) to acquire this debt. I am the executor of my fathers will and am getting ready go to probate court. Is my mother going to be responsible for this debt? Your response to this question is greatly appreciated sincerely.

If your father was the only obligor on the credit card, the creditor will have to file a creditor's claim in the probate proceeding. You will have to give notice to creditors. If you need a probate attorney and reside in northeast Oklahoma, you can contact our firm regarding possible representation.
