Worked under contract and didn't get paid

I worked as an independent consultant for an individual who is established as a sub chapter ''S'' Corp. His contract with me specified that I need to obtain professional liability insurance to work for him. Since I was just starting out, he was very lenient with this portion of the contract. After about five months, he stopped using me and stopped paying me, citing he didn't have any work for me. After the interruption in work, he said that he has every intention of paying me, but now says ''You never got your insurance. Get some and I'll pay you.'' Can he use this as a reason not to pay me after I have already done the work? He still owes me about $5000.00.
