Legal Question in Criminal Law in Oklahoma

I am on a 5 yr deferred sentence, they issued a motion to accelerate for failure to pay restitution, public intoxication, driving under suspension, and they are trying to put me in drug court or 2 yrs in prison and i have never been charged with a drug charge ever. I don't think it is right. What can I do? Can they do that?

When a Defendant is on probation for a deferred sentence, he is not supposed to violation any laws. He is also supposed to pay his fines and costs. Committing new crimes and not paying will result in a motion to accelerate as it has in this case. The state can ask to put you in prison for the maximum sentence for the crime that you are on probation for. So the answer is yes the state can put you in prison or give you the option of drug court.
