Application to acclerate

i was charged with burg. 2 and pled to b&E. My co defendant was convicted of the burg. 2 and sentenced to five years DOC. I was given a 3yr deferred. I haven't kept up my probation fees or community service and I just found out a motion to acclerate has been filed. Do i need a lawyer again? IF the judegement is acclerated will i be convicted of the felony burg 2 or the misdeameanor b&e?

Yes, you need a lawyer. If the motion to accelerate has been filed, you have a warrant for your arrest right now. If the DA will agree, your attorney may be able to get you on the court docket without your having to be arrested. You attorney is also going to work out a deal with the DA so you do not have to go to jail.

You cannot be convicted of the burglary 2nd. The only thing you can be convicted of is what you pled to, which is breaking and entering.
