Legal Question in Criminal Law in Oklahoma

My brother in law was aresseted for i believe assult. But I'm not 100% that is the charge yet. But if it is what is the max penilty he could be facing? My sister in law said the officer who showed up at the crime said because his childeren where in the house it is a felony. This occured in the state of Oklahoma.

This question cannot be answered with the information provided. Assault carries up to 30 days in the county jail. However, your question indicates this may be a felony. I know of no assault that becomes a felony because children were present. However, there are many different types of felony assault. The punishment for those depends on the exact charge, and it depends on how many prior felony convictions the defendant has.
