Legal Question in Criminal Law in Oklahoma

Death By Homicide

A file was discharged because the victim was 35 & the person he was wrestling with was 17. (The 35 year old died.) I'm told that a medical examiner's report states it was ''Death by Homicide'' and that he was choked to death. Wouldn't the police department make an immediate arrest using what the ME's report showed? Why would they wait a year and half later to make an arrest? Were they waiting for him to turn 18? Can the police department do that?

Re: Death By Homicide

There is no statute of limitations on murder in Oklahoma. They may have been waiting for information to develop or for the defendant to further incriminate himself or it may be politics or burecratic incompetence. He must immediately stop talkjing and get a lawyer. The fact that he was a juvenile doesn't matter. Murder is a reverse certification crime. I'm out of town until the 6th of August. Call my office then if you like at 231-4343.
