Embezzelment
What is the penalty if someone is charged with embezzelment (small amount) and the intent was to pay it back? It was a misunderstanding.

If the intent to repay and the misunderstanding can be proved by courtroom-quality evidence, there is no penalty.
Conviction for criminal embezzlement requires proof beyond a reasonable doubt that the accused intended to deprive the rightful owner of the money/property wrongfully and permanently.
