Legal Question in Criminal Law in Oklahoma
In Oklahoma, My daughter-in-law called the police because I threatened her with a knife. The police released me at the time. but she filed charges that night. The next day she went to drop the charges and gave them a statement, saying she wanted to drop the charges. They told her it didn't matter if she dropped the charges. Will they still issue a warrant for my arrest?
1 Answer from Attorneys
No person files charges and no person can drop charges. If a police report is given to the District Attorney, the District Attorney, acting an behalf of the State of Oklahoma, files a case. Once a case is filed, only the District Attorney can dismiss the case. If a victim says she wants the case to be dismissed, it is up to the District Attorney to dismiss the case. Most of them will not.
