If you have a open bottle of liquor in the back of a truck is it still considered a "open container"?

An "open container" is going to be considered an "open container" no matter where in the car it is location. Opened is opened. The issue is is it illegal or not. The law says it is illegal to have an "open container" in a car "unless the opened container be in the rear trunk or rear compartment, which shall include the spare tire compartment in a station wagon or panel truck, or any outside compartment which is not accessible to the driver or any other person in the vehicle while it is in motion."
So I would say it is legal to have this open container in the back of a truck as long as it is not accessible to the driver or any other person in the vehicle.
