Legal Question in Criminal Law in Oklahoma
I was recently notified of a pending felony embezzlement charge for $2000 by the Tulsa Country PD. Last year i completed probation for the same charge and a similar amount, which was in turn expunged and now shows as a dismissal and plea of not guilty. While i'm very aware that all felony charges are very serious, i'm wanting to know if this could be charged as a second offense? With the right representation is a mandatory jail sentence inevitable if convicted?

This can be charged only if it is a different offense and not the same as the one last year. If it is the same exact crime or substantially related, then double jeopardy is in play and they cannot charge you.
