Legal Question in Criminal Law in Oklahoma

From out of state; Oklahoma (Osage)

I was recently charged with possession of paraphernalia and possession of less than a gram of marijuana, both misdemeanors. I live out of state and cannot afford a lawyer. I was told by the county clerk that I am not eligible for a court appointed attorney unless I pay for one. I have been unemployed for 18months so I may care for my grandfather.

Q1) Do I need a lawyer for such small charges?

Q2) How can I be ineligible for a court appointed attorney? Isn't that a basic right?

Q3) Will the fact that I live out of state effect me negatively in the courts decision?

States are required to appoint an attorney in cases in which you face prison or jail. No jail = no free attorney. Out of state will not affect the outcome.
