Re: Violation of Suspended Sentence
Without knowing specifically what your mental and physical issues are, I cannot definitively say they matter or help your case. Generally speaking, mental and/or physical disabilities will limit the amount of fines & costs a court will impose on a defendant, if your lawyer made the court and the district attorney aware of the disabilities. Most courts in Oklahoma will allow defendants to make monthly payments on fines and costs, usually around $50 per month.
If you are unable to make the monthly payments on your fines & costs, you need to hire a lawyer to renegotiate your payment schedule or have him or her work out some other type of arrangement. If you do nothing & ignore the problem, the State will eventually file an application to revoke your suspended sentence and try to send you to prison for violating the terms of your probation (failure to pay fines & costs). A good attorney should be able to negotiate some type of deal that lowers your payments & keeps you out of prison. However, you need to speak to an attorney and give him or her the details of your case so he or she can evaluate your specific situation.
