Legal Question in DUI Law in Oklahoma

Can a passenger get a DUI?

I was very intoxicated one night, so I called one of my friends (who was completely sober) to be my Designated Driver, and drive me home in my car.She drove and I rode in the passenger seat. On the way home we were pulled over by a police officer, who asked me if I had been drinking...to which I answered yes; he proceeded to ask me if the car that we were in belonged to me, and again I answered yes. He then gave me a DUI. I am so confused! How could he give me a DUI when I was not driving, nor in control of the Vehicle? Can he do this? Please help!

Sincerely

T.H. of Oklahoma

Because you only have a brief time to stop a revocation of your driver's license in a DUI arrest, I STRONGLY recommend that you contact my office ASAP (like tomorrow!!) Call 405-232-3388

I suggest that you hire an Atty immediately. Unless you were in control ov the vehicle, you have an excellent defense.
