Can my moms sister take powe atty from me and sue me
I have powe of attorney over my mom and had control over her finances. She was put in a nursing home. Her sister is trying to get power of attorney and say that I embezzled my mom's money which is not true. Does my aunt have any legal rights and what do you suggest I do? I can not afford an attorney and need some legal advice. My aunt is always trying to cause trouble any way she can. Thank you kindly--feel free to call me. Thank you for your question. The aunt could become the power of attorney if your mother gives her such right. However, your mother may not be mentally competent to do so at this point. Your question doesnt provide much information on her level of competency. The aunt could also seek court appointment as the guardian of your mother and her estate which would revoke your power of attorney authority. You would have priority over your aunt to be appointed guardian if a petition seeking guardianship is filed. You could also seek guardianship and thereafter have court oversite of the matter.
