12 years ago when my husband was in college he had been ''kinda seeing'' this girl a few months later she told him she was pregneant and did he want to be on the birth certificate he said no! When the baby was 6 months old she looked him up, for about a month she brought the baby to see him,(he was trying to have a reltionship with the baby) then all of a sudden she never came around. He tried to call, left messages no return, so he went on. We've been married 9 yrs. A few months ago she sent us a letter wanting child support and if he didn't she would try for 12 years back. Can she go for back child support when she left and wouldn't return his calls? She also doesn't want to give him visitation, but he accepts this child and is willing to pay and try to have a relationship with this child shouldn't he get some visitation? If we come to some sort of agreement on child support & visitation, do we have to hire lawyers or can we do the paperwork ourselves?

She can only get child support retroactive to the date she files for child support, not 12 years back. Yes, your husband can sue for visitation, but I strongly suggest retaining the services of an attorney.

She can only get child support from the date she files a petition asking the court to set it....I would do DNA testing before accepting any responsibility, especially since the child and the "father" have no relationship...also, think of the child and what effect this sudden appearance of her "father" may have on her....if he "accepts" the child, why didn't he exhaust every effort to find her these last 10 or so years?
