Is it abuse if I consent?

My husband and I live a lifestyle of Domestic Discipline, which basically means he is the head of household and he makes the rules and applies appropriate consequences for failure to abide by the rules and/or generally acceptable behavior. We have a contract which specifically states that I choose to accept this lifestyle, that I want it to be this way, and that everything that falls within the boundaries of the contract is consenual. The question we have now is this: if the appropriate (and consensual) consequence for a behavior is a spanking (the exact application of which is laid out in our contract), can he be arrested, charged and possibly convicted of spousal abuse if another party overhears or accidentally witnesses the situation and calls the police?
