Legal Question in Family Law in Oklahoma

age child can choose household

my ex gained custody of my son through a bunch of lies. my son will turn 14 this week and has stated to myself and my fiancee that he would like to live with us but is scared to tell his dad. his dad doesn't give him much attention or take him anywhere. his stepmom is the epitamy of the evil stepmom. is there a law that will allow my son to choose to live with me at age 14 or what steps will i have to take to get him back. i didn't go to the court date because i was not told the date and my attorney had told me he was removing himself from my case because of lack of money and then he didn't remove himself till the day of court but didn't let me know. i want my son back and he wants to come back. i would appreciate any info and/or advice you can give me. we thought about approaching his dad about me regaining custody. what is your opinion? thank you,--name removed--alexander

Re: age child can choose household

Thanks for your question. In Oklahoma a child of that age is pretty much entitled to choose which parent he wants to reside with. This should be handled through the courts on a motion to modify.
