Age of consent

i had joint custody for 5 years, 33 months ago my son's stepdad abused him i was given temp.sole custody, she had supervised visit, then she quit seeing him because she did not want sup. visits, i was award full sole custody and child support, she walk out of counseling and told our son she wanted to terminated her rights, she fired her lawey and told the gal lawyer and mine she wanted to terimate her rights, she did not show for court the judge gave her every opponunity to get her rights, she did not try. the judge asward my lawyer fees to me and now she has come back and wants joint custody, it has bee going on for 33 months no contact at all for a year and 6 or 7 times all to gether, no support at all. he will be 13 in 2 weeks, when can he make a desecion about whre he lives, i took him to counseling for 18 months he is just now starting to be back to normal and the anger is returning when he heard his mother wants back in his life. can he have a say so or does he have to live the life she has( men, beer, drugs)

You indicated that you have a lawyer ... talk to your lawyer! The standard of review is the "best interests of the child". it is up to the judge to decide that, not you, I or a 13 year old. However if what you say is true, it is unlikely that Mom will be successful with anything other than visitation, and probably not much of that.
