Legal Question in Family Law in Oklahoma
I agreed in my divorct to pay 350.00 every other week to my ex to cover debt incurred during the marriage. I was to pay this until a total of 29000.00 had been paid. I deposited this money in his account every pay day. A few months ago he ask me a copy of my 2010 tax return. Since we were divorced in April of 09 I seen no reason for him to have it so I told him no. He got pissed off and went to his attorney and had my wages garnished. By Federal & State laws he can only garnish for so much so now he is only getting about 235.00 every other week through garnishment. He emailed me today and said that his attorney said I had to pay the rest personally. My question is can he do anything to me legally if I dont? seeing that he has already garnished my wages

If the divorce decrees states you are to pay $700.00 per month and all they are collecting through a garnishment is $470.00 per month you would still owe and be responsible for the difference. If you fail to pay, your ex could file a contempt (willfully disobeying a court order). Good Luck, Bob Adcox
