If you are legally married, the money and/or assets are considered joint property or property obtained during the course of the marriage relationship. A judge will take this inconsideration during the divorce and divide them according. In the meantime, it is recommended that you get an attorney to represent you too. Then, the party will have to negotiate this with your attorney.
