Legal Question in Family Law in Oklahoma
re: Back child support vs paternity contract
I have a paternity contract betw myself and child's father.
Paternity is established, currently in law suit. The judge intends to support the contract in disallowing my claim to back child support. The father, five months ago, quit paying support, until I filed suit; then he began paying again. How can the judge disregard the paternity contract that established paternity, order dna testing; then turn around and regard contract as a legal document? Do you know of any cases that sets precedence in Oklahoma? Can you steer me in the right direction to find info on such cases?

Re: re: Back child support vs paternity contract
I am not sure I understand what you mean by a paternity contract. I understand that your question may be asking whether a parent can agree by contract to release the other parent from support obligations. As a general rule they may not. If this is a child support issue you should seek out an attorney to represent you. There are attorneys who will handle such matters under an agreement to be reimbursed out of the back child support collected. If you want to do your own research go to www.oscn.net and use their research library of cases. I suggest you use a word and phrase type approach in your search terms. Always put an "and" between each search word. Good luck and if you need assistance locating an attorney in the Tulsa area let me know.
