Beating up on Step-Child

My step-daughter, who lives in OK, was beat-up (thrown to the ground, and given a black eye) by her stepfather while her mother watched. Dad (who lives in MI) didn't find out about it until 2 months later.

DHS has investigated (child filed complaint), and recommended counseling for OK family. Is there ANYTHING dad can do at this late date?

This is in response to your email of September 5, 2001, which this office received on October 24, 2001.

Unfortunately I cannot answer your question for a number of reasons. First, I am unclear where your stepdaughter was when she was beat-up. Secondly, if your stepdaughter was in Oklahoma you will need to contact an attorney in Oklahoma who is familiar with that states laws. Finally, I am not sure whether you want to pursue a civil action for money damages on behalf of your step-daughter, or if you have a custody/parenting time issue.

See if your daughter wants to move in with you. If she does, take steps to transfer custody by filing petition in same court that granted the divorce. The older the child, the easier it will be...although it never is easy. She will appreciate it when she is older and realize you came to her aid. Then explain to the step father that if he ever touches her again, there will be more to answer to than just the courts.
