Legal Question in Family Law in Oklahoma

Name Change

I'm wanting to get my son's last name changed. I gave my son his father's last name and his father took off. Do I need to request a name change in the state he was born in? Or can you do it in any state?? Also, do I need his father's approval?

Re: Name Change

You should be able to bring the action in Oklahoma, but you'll have to comply with procedure to notify the father, and he'll have a right to answer and object (not that he'll necessarily win). Oklahoma has ruled the father has an interest in having his child retain his name, but as with much of the law, the specific facts of the situation will make or break your action.
