Chaning a minors surname- Again
2 1/2 years ago I found out my husband was a bigamist who had never divorced his first wife. I had the marriage voided, my maiden name restored and the surname of our 7 month old daughter changed to my maiden name. My ex AGREED to her name change, he signed a notarized statement that he agreed and he also signed the paternity decree which stated her last name would be changed. The moment the judge signed the decree I had both of our names changed. That was 2 years ago. He has not seen my daughter in over a year and made no contact until recently and my daughter does not know who he is. She just turned 3 and she knows what her last name is. I recently learned that my ex has reconciled with his legal wife and intends to take me to court to have my daughters name changed BACK to his. Since he already agreed to her legal name change and we were not legally married at her birth can he change her name back to his without my consent? I remarried two months ago and did not take my new husbands name. It's very important to me that my daughter and I have the same last name. I should also point out that I have sole custody.

He can try, but based on what you've stated you have a strong defense. I do suggest, however, if it is as important to you as you say it is, you get an attorney to defend your rights.
