my ex is claiming her friend that babysat our son for a few hours a day was ''child care'' she never once asked me if i could take care of him and i have right to first refusal. am i required to pay the babysitter even though i could have in fact taken care of my son myself?

It all depends on the specific requirements of your decree. Based only on what your question states it's difficult to answer with certainty. If you are to be given first right and consistently are not, then you may have an argument; however, under certain circumstances it would not seem unreasonable to have a babysitter. The details of your decree and the situation are most important.
