Child Custody

I need to know if I have a chance in gaining custody of my 12 year old daughter since she has lived with her father since she was three. Two years ago I custody of a child due to failure to protect. The environment my daugher is living in is not safe, heathy or tolerable for her any longer.

The issue for the court hearing the matter would be whether there's been a material change in the circumstances of the child and custodial parent sufficient to warrant a change of custody to you that would be in the best interests of the subject child.

Based upon the few facts that you've offered here, I'd say here's no way to predict how the court would rule one way or the other.
