Legal Question in Family Law in Oklahoma

child custody

I signed and notarized a paper giving my mother temporary custody of my children, until i got back on my feet, she told me that she hired a lawyer and a court date has been set for her to obtain court custody of my children, she has hid my children from me, refusing to let me see them, and i have not received anything from her lawyer or the court for the hearing, do i have to have a subpena or something from her lawyer/court before she can go through the hearing? and what can i do about her refusal to let me see them? can i not just call the police and have them make her give them to me? my children are in ok and i am in tx

Re: child custody

Hopefully, an OK lawyer will respond as the law may differ from Texas.

In Texas, in order to proceed, (absent an ex parte order) they must have service on you. They may have advised the court that they do not know how to locate you, and have obtained a right to substituted service, had an ad litem appointed, and are going to proceed without you.

Although the court may not have acquired jurisdiction over you, the safest thing to do is to hire an OK lawyer to investigate the law suit, and to protect your rights.
