Legal Question in Family Law in Oklahoma
child custody with visitation and support
I am an unmarried mother of a two year old girl. Her dad and I separated 9 months ago and have been splitting custody. Everything has been cut in half, money, visitation and holidays. He constantly harasses me because he is an alcoholic and it was a bad break up. I am seeing an affect on my daughter because of his anger and drinking. For the safety and well being of my child I want full custody of her and open visitation with support. I also need some legal documentation that it would be ok to move out of state if the opportunity arises. As long as visitation is arranged.

From your question, you really don't understand the way it works. First, if you have never been married then he is not "Dad". Oh he may be from a realistic standpoint, but until he files a paternity action in Court or something else happens in Court and a judge enters an Order establishing paternity, then the child only has one parent - YOU!
Yup, you could hit the road today and he could not do a thing about it.
Visitation is the same thing. Until there is a Court order, there is no visitation that he can enforce.
From a practical standpoint, if he goes to Court, he will get Court ordered visitation, child support, etc ... But not until a judge says it is so.
