Child Custody

If a 2year old lives with his mother in oklahoma and the father lives in texas and the father wants to file for custody where would the court have to take place tx or ok? He pays child support but she won't let him talk to his son. She's on welfare and the fathers not, are his chances better than hers? She is also Indian is there any laws that would interfere with custody for the father?
