Legal Question in Family Law in Oklahoma

child support modification, retroactive an option?

I'm modifying my child support and since my ex husband provided tax returns, his income is higher than expected. There was a modification years ago, that I typed myself, for which he did not show up for court. Since it is a small town, and the judge knew us both, she asked me his income and all I could provide was an estimate from when we were married years before, she used this to detemine support. Can I get retroactive child support based on the courts negligence in not making him provide income verification?

Re: child support modification, retroactive an option?

nope ... what you can do is get it raised prospectively based on new evidence before the Court.
