Child support when non-custodial parent is self employed

My two childrens father is self employed in the state of Colorado. He claims he makes $9.00 an hour as a drywall sub-contractor. He lives in a $175,000. house and drives a $30,000. vehicle. Does any of these things matter in a modification hearing?

Thank you for your question. Your question suggests that you believe his $9.00/hr report of wages is not consistent with his life style and that maybe he is not being truthful. You could be correct. Modifications of child support is based on a material change in cirucmstances and not necessarily a change in the income of the payor Dad/Mom. If you question is whether you could present evidence about of these things to try to show the court that he makes more than $9.00/hr, I believe that you will be allowed to. An attorney would certainly try to discover the true nature of his earnings and require him to account for how his lifestyle could be supported on $9.00/hr.
