Child withdrawn from school

My divorce decree states that my Child support will end when child reaches 18 or graduates, whichever occurs last. Well, unfortunately my child was withdrawn from school due to excessive abscences. She is trying to get into an alternative school so she can graduate on schedule, but this has not happened yet. Does my obligation end since she is no longer officially a student?

P.s. I am not a creep just trying to get out of paying, I have provided far greater care than was required. I would like to be able to invest this money in my childs future my own way.

Thank you for your question. The language of your divorce decree will need to be interpreted by a judge to resolve any confusion. I would interpret it to provide that child support will continue until the child is 18 even if not enrolled in school. However,it also appears that it would continue beyond her 18th birthday if on her 18th birthday she is duly enrolled in school. Your post does not indicate the age of the child. If the child is now 18 and not duly enrolled in school then I would think that your child support obligation has ended. Any other interpretation would mean that you would continue paying child support forever if the child never completes high school. You may want to consider putting the child support in a bank account until the matter is finally determined.
