Thank you for your question. If you have an attorney this should be better answered by your attorney as he will know the disposition of the local judges concerning this set of facts. You might have a talk with the District Attorneys office to see if child theft charges would be appropriate. The age of the child,whether it is in school, the fitness of the competing parents, living conditions and many other factors would come into play in obtaining an emergency order within the confines of a divorce action. As a rule I dont think judges look very kindly on these type of situations where one party has essentially stole the child.
