Legal Question in Family Law in Oklahoma

Common Law Marriage information

My mother and step-father married in Tucson Arizona on March 21, 1967, they met at the ages of 24 and 22 and found out they were first cousins, they however , married anyway. Now they have lived in Oklahoma for the last 20 years aand are separating, do they have to get a divorce or since the marriage wasn't legal to begin with will this be necessary? Also where does this leave my mother since my step father owes social security taxes on his business since they have filed joint income taxes since 1967. My mother is totally disabled and only has a monthly income of 450.00 per month, again this would n't be federal taxes only his social security. Also would she be able to draw social security benefits from my deceased biological father? Her current age is 60.
