Contempt penalty

I have spent overnights repeatedly with my fiance and her young son since her divorce was finalized. It is in her decree that there are to be no overnights with a person of the opposite sex while she has visitation. She was given sole custody and her ex was given no overnights with the child due to a DUI and other alcohol related issues he has. My question is now that he has filed a contempt of court against her for my overnights, and she plans to tell the truth that I have in fact spent the night repeatedly, what possible penalty could be imposed on her and what is most likely to be imposed? We plan to marry within the next two months, but probably not before the contempt is heard.

No one knows for sure what the Court may order until it is ordered. However, the standard used is the best interests of the child. That is a very loose standard which basically gived the judge the power to do anything. The problem you have is that you have a Mom that will not follow the Court's orders, and you have a dad that is an alkie. What happens is anyone's guess, but the judge could change custody!
