Legal Question in Family Law in Oklahoma

custody cases

I live in the state of Kansas and my ex-husband lives in the state of Oklahoma. The original case was heard in Cleveland county. The past two years the kids have been residence of Kansas. Who has does a new case have to go in front of? Oklahoma or Kansas? Neither one of us live in the same county anymore.

Re: custody cases

I would file a motion to transfer the case to Kansas as that is the home state of the children now. Once the motion is filed, the judge in Kansas is required to contact the OK Judge if the Kansas judge decides to take a look at the case. Drop me an email if you have further questions.
