Legal Question in Family Law in Oklahoma
Custody of 17 year old
I recently heard that a new law has been enacted where Judges and/or the Court is bound to consider children's preference as to where they want to live if they are over the age of 12. I have a 17 year old daughter whose father has had temporary custody for the past two years. Is this correct in what I heard and how do I go about filing the papers myself (can't afford an attorney)and what steps do I need to take. Thank you very much on our behalf for any help.

Thank you for your question. You may have more updated information than I do on this if this is just recently passed and signed by the Governor. In the past there has existed a law which permitted a child of 12 to give a preference where he wants to live but the judge could disregard it if he felt it was not if their best interest. You might want to check with Legal Aid for free or reduced fee attorney help on this.
