Legal Question in Family Law in Oklahoma

What can i do to keep my daughter (grandaughter)?

I was at the hospital when my grandaughter was born on my birthday, held her first, and was there the whole time. She did not bond with the mother but with me,so I have had her ever since. She is now almost 8 and my husbands name is on the birth certificate because my daughter gave her to us at birth. I have a noterized statement from my daughter giving me custody and she knows she has two moms, me and her biological mom. All of a sudden tonight her bio dad has his sister call and tell us she is going to do dna and I have never kept him from seeing her. What can I do she has always been ours and we are afraid of losing her because we were told my husbands name on the birth certificate is not holding?

Re: What can i do to keep my daughter (grandaughter)?

Thank you for your question. The threat by the sister of the reputed father may be nothing more than an attempt to cause you concern for reasons known only to the caller. On the other hand it may be a prelude to some form of legal action by the supposed father to gain custody. Without knowing more facts and review of your paper work it would be impossible to give you a definitive legal opinion. One thing you may wish to consider is to obtain legal guardianship through the courts which would provide some immediate protection. Depending on where you live, I might be of assistance to you in reviewing your situation and making recommendations and possible guardianship if warranted by the facts.
