Legal Question in Family Law in Oklahoma

She dissapeared with the kids and won't finalize the child issues

My new husband's ex has been disappearing since she kicked him out of their new home in 1999. She has lied to the Pa, Fl, and now the Ok DHS offices since then. Each time she says he aboanded them with no money. He proved to Pa she was lying and they dropped the case and stopped her welfare for her lying. The divorce was granted here in 2001 after the atty couldn't find her. Then Fl. contacted him, the atty told them the situation and sent them the papers for the child issues that are still not finalized. She was gone again. Now Ok is after him, he told them what has been going on.They won't listen.Does he have any rights at all?How can he find his kids and see them?

Re: She dissapeared with the kids and won't finalize the child issues

Thank you for your question. I am assuming from your post that the ex has the children with her and there is not a court decision giving either one permanent custody. First, your husband should be asking his attorney for advice on this. It appears that if she has taken the kids out of the state where the divorce was filed with the intent to avoid the court's orders, then these facts should be shown to the court and the court might award custody to your husband. At present it appears that he is not the parent with custody rights. This might help his position with law enforcement agencies if locating her or in getting charges against her as for child theft. As for finding the children, a private investigator might be necessary. There are many organizaions on the internet which have resources in helping to locate missing children. For instance if you have computer access, and most public libraries do then you might try some of the following links. I have left off the normal (www.) which should be added before you type in the following: childfindofamerica.org; missingkids.org;gomcs.or;findkids.com; and one site, divorceresource.com has a link to a public records search which for a small fee will search and provide a report. Almost all search engines whether through Yahoo, AOL, MSN, Lycos, have links to locate people. Bigfoot.com also has some free resources. I hope thatlawguru does not remove these internet sites from my reply. If the do then please contact me and I will provide the information to you direct.
