Legal Question in Family Law in Oklahoma
Divorce and property
I signed a quit claim did for house and property but now I am having trouble with credit because it shows up on my credit checks causing trouble in purchasing minor things. Can I go back and force him to sell house and car to get my name off , or will I bedoomed for the rest of my life. He gets more in debt every day and I also fear he will declare bankruptcy. I feel I can not purchase anything without the risk of it being taken away when he finally does this, plus the agrivation of not even being able to purchase a car because his home and car show up on my credit. He ripped me off for all my money and now I still have his shadow hanging over me.

Re: Oklahoma Divorce and Property
Unless your decree has language in it dealing with this situation, you will not be able to force your ex to sell the property or refinance the debt to remove your name from the obligation. If your ex defaults on the debt and you are forced to pay all or a portion of the obligation, then you can file a contempt action against him (assuming your decree contains the standard hold harmless language).
If he files bankruptcy, there are a few limited grounds for objecting to his discharge or the dischargeability of a particular debt.
I recommend that you discuss your situation in depth with your attorney to determine if there is anything you can do now, before the situation gets any worse.
