Legal Question in Family Law in Oklahoma

I was divorced in June 2009. My ex-spouse is still residing in our house which is in my name only. She is consistantly late on the mortgage payments. I'd like for her to move out, but do not know my legal rights. Also, she has just given birth to a child (not mine) so I do not know if that has any ramifications on the matter. The house has been on the market for some time now with no success. I'd like to take possession of the home. Thanks.

If your Decree awards you the property free of any interest by your ex-spouse, then you can treat your ex as a tenant. If there is no lease between you, then you can give her a 30 day written notice and terminate the tenancy. If your Decree provides for anything else, then I would have to review the Decree to be able to explain what your rights are.
