Hello,
I retained an attorney in July of 2006. He was seeking a modification of child support, support in arears, a contempt of court on an order filed a year prior for payment ordered through our divorce, and payment of medical and childcare expenses that my ex husband refused to pay. It has been four months and nothing has been filed. I call, i email, i leave messages. Once every six weeks or so he calls and acts exhausted and is ''so busy but has been working hours and hours on the case''. Each time he tells me we can have a court hearing in two weeks and then i hear nothing. I just recently left him a voice message and an email stating i want results in 10 days or my retainer fee returned. Again, i have heard nothing. In addition, when he does call, he spends over half of the conversation talking about how much he loves the coffee where i work. I know attorney's charge for phone calls. I was referred to this guy by a reputable friend and attorney and don't want to get him involved as they are friends. What can i do?

I cringe when I hear these types of stories, but I know they do occur. You have already been more than patient. If it takes 4 months just to file a motion to modify and a contempt citation, how long is it going to take him to see them through? Unless you are aware of a reason for the delay, fire him now and hire someone else. I would also demand that he refund ALL of your retainer.
