I have an elderly mother who has cancer she was living with my sister who has not been taking good care of her, the atmosphere at the house was very abusive and neglectful. She is currently in the hospital after just having brain surgery. My sister will not allow any one else to care for her. What can I legally do to take custudy of my mother so that she gets the care that she needs. She will not come with us on her own because she is mentally incapacitated.

You should hire an experienced family law attorney to ask the court to appoint you as guardian for your mother. If your mother is being abused, immediately report that to Adult Protective Services.
