Grandparent visitation agreement
My husband has custody of his two children (9&11yrs).Mom hasn't seen the the children since September 2001 due to drug addiction and unsafe living conditions.Maternal Grandmother has requested visitation one weekend per month as long as mother is not exercising her visitation.(She filed for her rights and was denied.)Father has agreed to allow children to visit, but with conditions.What information is needed in typing his own visitation schedule and conditions in order for it to be legally binding? Does it have to be notorized or just include both signatures?

Thank you for your question. In Oklahoma a grandparent is not entitled to visitation if one of the parents objects. Therefore, with that in mind, my answer as to what the legal effect of a written agreement for visitation with the grandparent may have is that there is no legal effect. But I am not sure that I would want anything in writing with the grandmother other than directions as to what or who she should not permit in or around the children, etc. If she violates the rules, no more visitation or more limited visitation as father desires. If both were to sign an agreement, notorized or not, it might be used later by the grandmother to try to win court ordered visitation.
