Legal Question in Family Law in Oklahoma
Grandparents Need help badly for Grandchild!
Please help us!
I went to an attorney yesterday and he said he is not current on the laws of Grandparents rights.I lost my money there!
My granddaughter told me that her step dad made her eat vomit after she got sick from being to full.
This is not the first time that he has done something cruel to my granddaughter.Mother was at work when this happened.
When I tryed telling her before she want believe me.
I would like to know how I get custody even if temporary for my granddaughter?
I am in fear for her life.
I don't trust the DHS because I don't want to loose her to the system either.
I do not have alot of money and I feel like my hands are tied but I know there has to be a way.

I seldom tell folks to get DHS in their lives, but I think that is the only way you will accomplish your goal here. If you get DHS to place a hold on the kids, and then go to Court, the judge can place the kids in your custody. Other than that, you have a very expensive path in front of you.
Grandparent's rights is not the path you want to pursue, Guardianship is! The standard is "The best interests of the child"
Talk to an Atty that does family law, and who does not charge for the first meeting, If you paid someone to tell you that he does not know, then get your money back!

You could seek guardianship. If you do I would recommend that you talk with DHS and let them know of your plan and serve them copies of the Guardianship Application. They might agree to come in on the girls behalf and at least investigate during the period that you have temporary guardianship. That is if the court grants temporary letters of guardianship if which case a hearing would be scheduled. A Guardianship would require a $1500 retainer fee for me to become involved.
