guardianship of a child when parents aren't married and father is locked up

Parents weren't married, father is in jail and the grandparents have co-guardianship of the child. Will the maternal grandparents have more rights and be able to get full guardianship of the child since the father is in jail and mother can't take care of the child?

The answer is not so black and white; rather, the court will look to the totality of the circumstances in an effort to provide for the best interests of the child. The court has a considerable amount of discretion to consider many things if they affect what's in the child's best interest.
