Guardianship

Could you tell me what happens in a pre-trial? I am not able to be represented and need to know how to act and what will the procedure be like.

Also, I would like to know what I need to file and do to ask for custody of my granddaughter.

A pretrial involves a conference at which the attorney/parties if representing him/herself appear before the court and talk about the issues, evidence and witnesses in the case. A pretrial conference order needs to be prepared. I suggest you ask the court clerk for a pretrial form to help you prepare your side of the case. The other party is responsible for preparing his/her side. For a grandparent to obtain custody over a parent, you must show that the parent is "unfit" by presenting evidence, pictures, witnesses, etc.
